Sending a copyright notice

To be effective under 17 U.S.C. 512(c)(3), a written notice must include each of the following:

  1. A physical or electronic signature of the copyright owner, or of a person authorized to act for the owner.
  2. Identification of the copyrighted work you say has been infringed. If one notice covers several works, a list of them.
  3. Identification of the material you say is infringing and want removed or disabled, with enough detail for us to find it. A link to the page and a description of the photo or text is ideal.
  4. Your name, mailing address, telephone number and, if available, email address.
  5. A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act for the owner.

When we receive a complete notice we remove or disable access to the material promptly, tell the person who supplied it (for MLS listing content, the listing brokerage through Stellar MLS or MLS Grid), and keep a record of the notice. A notice that knowingly misrepresents infringement can carry liability for damages under 17 U.S.C. 512(f).

Counter-notice

If material you supplied was removed and you believe that was a mistake or a misidentification, you may send a written counter-notice to the designated agent. Under 17 U.S.C. 512(g)(3) it must include:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and where it appeared before removal.
  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled by mistake or misidentification.
  4. Your name, address and telephone number, a statement that you consent to the jurisdiction of the federal district court for your district (or, if outside the United States, for any district where Inspired Nooks Realty, LLC may be found), and that you will accept service of process from the person who sent the original notice or their agent.

We forward a complete counter-notice to the person who sent the original notice. Unless they tell us within 10 business days that they have filed a court action to restrain the alleged infringement, we may restore the material in 10 to 14 business days after receiving the counter-notice.

Repeat infringers

We end the accounts and access of people who repeatedly infringe the copyrights of others, and we may end access after a single clear violation. Where listing content is involved we also report the matter to Stellar MLS and MLS Grid as the license requires.
